Important Information About DWI Penalties
If police officers stop you and believe you are intoxicated, they can issue a test through a Breathalyzer to analyze your blood alcohol content (BAC). A blood test may also be required and field sobriety tests will likely be conducted. Refusal to submit to these tests is a violation of the law, which will result in a one-year suspension of your driver’s license for a first offense. The prosecution will use the results of these tests to seek a conviction.
In Virginia, you are considered to be driving while intoxicated if your BAC is .08 percent or higher. A first offense is considered a misdemeanor and carries a fine between $250 and $2,500. If you have a BAC higher than .15 percent while driving, you will receive a mandatory sentence of five days in jail. A first offense also carries with it a one-year suspension of your driver’s license and a requirement to complete an alcohol safety program. Fines increase if a minor is present.
The penalties for second and third offenses increase significantly.
